Terms of Service

These Terms of Service ("Terms") govern access to and use of the Waggsywebsite and software (the "Service") provided by Waggsy Ltd("we", "us", "our"), trading as Waggsy. By creating an account, starting a subscription trial, or otherwise using the Service, you agree to these Terms and our Privacy Policy.

Waggsy Ltd is a private limited company registered in England and Wales (company number 17401734). Registered office: 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ.

If you use the Service on behalf of a dog training club or activity centre ("Club"), you confirm you have authority to bind that Club and that you are at least 18 years old.

Waggsy provides tools for club owners and administrators to manage timetables, sessions, member invitations, bookings, and related club operations. Features may change over time. We do not guarantee uninterrupted availability and may perform maintenance with reasonable notice where practicable.

The Service is aimed at clubs based in the United Kingdom. You are responsible for ensuring your use complies with local laws that apply to your Club and members.

You must provide accurate registration information and keep your login credentials confidential. You are responsible for activity under your account. Notify us promptly at hello@waggsy.net if you suspect unauthorised access.

We may suspend or terminate accounts that violate these Terms or pose a security risk.

Access to club owner features may require a paid subscription. Plan names, prices, member bands, and included features are shown in the app at checkout and may be updated from time to time.

Where offered, a free trial lasts 14 days. You may be asked to provide payment details before the trial ends; unless you cancel before the trial expires, your chosen plan will begin and you will be charged according to the billing interval shown at checkout (typically monthly).

You can cancel from Club settings → Subscription. If you cancel during a free trial, the subscription ends immediately and we will not take payment at the end of the trial. If you cancel a paid subscription, you keep access until the end of the period you have already paid for, and we will not collect further subscription payments after that period.

Payments for Waggsy subscriptions are processed by Stripe on our platform account. Card and invoice history is also available through Stripe Customer Portal. Fees are generally non-refundable except where required by law or expressly stated otherwise.

We may change subscription pricing on reasonable notice. Price changes usually apply from your next renewal after notice.

Separately from your Waggsy subscription, the Service may allow your Club to accept payments from members for sessions or events via Stripe Connect. Those payments are between your Club and your members; Stripe and Connect terms also apply. We are not a party to those transactions and do not hold member funds on your behalf except as facilitated by Stripe.

You are responsible for setting prices, refunds, and communications with your members regarding session payments.

As a club owner or administrator you control Club data, including member names, contact details, emergency contacts, booking records, and session information. You act as an independent controller (or joint controller, where applicable) of personal data you upload or generate about your members.

You agree to: (a) have a lawful basis to process member data; (b) provide your members with appropriate privacy information; (c) respond to member rights requests where you are responsible; and (d) use the Service fairly and in line with these Terms.

You must not:

• use the Service for unlawful, fraudulent, or harmful purposes;
• attempt to probe, scan, or compromise the security or integrity of the Service;
• scrape, reverse engineer, or resell the Service except as permitted by law;
• upload malware, spam, or content that infringes intellectual property or privacy rights;
• misrepresent your identity or your Club's affiliation.

We own the Service, branding, and underlying software. You receive a limited, non-exclusive, non-transferable licence to use the Service for your Club's internal operations while your subscription (if required) is active and these Terms apply.

You retain ownership of content you submit. You grant us a licence to host, process, and display that content solely to operate and improve the Service.

Waggsy and related branding are trademarks of Waggsy Ltd. A UK trade mark application for the Waggsy name has been filed and is pending. Until a mark is registered, we do not claim registered trade mark status.

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or meet every Club's requirements.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited under applicable law.

Subject to the above, we are not liable for indirect or consequential losses (including loss of profit, revenue, data, or goodwill). Our total liability arising from or related to the Service in any twelve-month period is limited to the greater of (a) amounts you paid us for subscriptions in that period, or (b) one hundred pounds (£100).

You may stop using the Service at any time and cancel subscriptions from Club settings → Subscription. We may suspend or terminate access for breach of these Terms, non-payment, or to protect the Service.

On termination, your right to use the Service ends. Provisions that by nature should survive (including liability limits, intellectual property, and governing law) continue to apply.

We may update these Terms. We will post the revised version with a new "last updated" date. Material changes may be notified by email or in-app notice. Continued use after changes take effect constitutes acceptance where permitted by law.

These Terms are governed by the laws of England and Wales. Courts in England and Wales have exclusive jurisdiction, except where mandatory consumer protections in your country give you the right to bring proceedings elsewhere.
